94MB.com Terms of Service

A Violation of any of the below Terms of Service could result in the termination of your account, without refund, without warning.

94MB.com is a private service, which provides online services including Hosting, Domain Registration and Marketing. 94MB.com reserves the right to cancel any account for any reason or no reason at all. 94MB.com will provide at it's discretion services to anyone that abides to our terms of service. 94MB.com reserves the right to change the terms and conditions at any time.

As of 9:00am February 2nd 2009, the following rules apply while using 94MB.com services:  

94MB.com Marketing Terms of Service

To use our service, you MUST accept these terms of service:

  1. You accept that if you do not contact us to cancel a service atleast 48 hours before the next payment is due, you that you will be fully liable for the next months services payment, including any late fees if payment is not made on time.

  2. You accept that by paying an invoice, you are committing to the services on the invoice. If you cancel these services before they expire, you will not receive a refund.

  3. You accept that in nearly all circumstances, monies added to your 94MB.com account, exceeding the amount due, is non refundable, but will be available to credit future 94MB.com invoices.

  4. You accept that late payments will incur a 25% additional charge.

  5. You understand that you must ensure select the correct budget and correctly type your website address. You accept the you will me fully liable for the budget(s) you select.

  6. You must ensure that your details in your account are completely correct. We reserve the right to stop providing services, without refund if we are unable to get in touch with you.

  7. You understand and accept that we will pass your details on to our collection agency if your account has any balances outstanding for more than 30 days. Additional fees will be levied.

  8. You accept that once we have fully setup your marketing account, the first months fee is non refundable.

  9. You accept that your 94MB.com account is considered active and our services started as soon as your marketing campaign is created. Upon creation, you will be sent an automated email with instructions on how you can activate the adwords, adcenter or yahoo marketing account.

  10. You fully understand that unless you activate your marketing with your chosen service provider, you will receive no traffic.

  11. You accept that it is your responsibility to check your emails, including your spam email folder and activate the marketing account. We are unable to activate these accounts for you.

  12. You understand that if you do not activate the marketing account with either Google, Microsoft or Yahoo that our management service is still considered active and you will be billed by us for all months the management service is considered active months.

  13. You accept that even though we will try to get you maximum targeted exposure for your budget, it is down to your website to capture and convert the visitors into customers.

  14. You accept that we are not liable for any losses that you may have incurred using our services.

  15. You accept that we are not able to make any refunds once the original paid time period of any service has expired. We may, in our sole discretion, credit you with additional months services.

  16. You accept that services 'credited', as explained in point 10, are non transferable, non refundable and may be cancelled by us at anytime.


  1. If you are a 94MB.com hosting reseller all the sites hosted under you will be regularly checked, if we find any of your sites breaking our terms of service the offending sites, along with ALL its files will me immediately terminated and the reseller will have a strike on their account. If your account reaches 3 strikes all the sites you host on your account will be immediately terminated and your reseller membership revoked WITHOUT REFUND. One strike lasts 18 months.
  2. Pornographic, obscene, nude, graphically violent, and other inappropriate content is strictly prohibited.
  3. Offensive and indecent directory names are not allowed and will be blocked.
  4. 94MB.com is not responsible for the content of any member homepages. We reserve the right to remove any homepages that are in violation of our terms and conditions. Members will be held legally responsible for the contents of their web pages for, but not limited to use of copyrighted material without the permission of the author or posting material considered indecent for minors. The use of 94MB.com Homepages for illegal purposes is strictly forbidden and the homepage will be removed without notice.
  5. All paid and/or free 94MB.com membership will be revoked if any of the following activities occur you also agree to pay a minimum $1,000 fine to 94MB.com to cover damages to our reputation:
    1. Adult or Pornographic related (unless you are a paid reseller)
    2. Hate, Bigotry, and/or Intolerance
    3. Warez or Software Piracy related
    4. Music Piracy Related
    5. Hacking Related
    6. Making available copyrighted software which has been "cracked" (e.g., copyright protection for the software has been removed)
    7. Making available serial numbers for software which can be used to illegally validate or register software.
    8. Making available tools that can be used for no purpose other than "cracking" software.
    9. Spamming in any form.
    10. Anything related to illegal activity
  1. We do not allow any type of programs, software, or MP3 files on our server unless you are the full owner and have all rights to the file. This includes files with the following extensions: our server .rar, .arj, .tar, .mp3 or .exe. If copyrighted files are found your website will be terminated immediatly!
  2. You and any person who has access to your account must evaluate, and bear the risk associated with, the accuracy, completeness or usefulness of any Content. 94MB.com reserves the right to remove Content, which is deemed in 94MB.com sole discretion harmful, offensive, or otherwise in violation of the Rules or any rules or policies 94MB.com, has in place at the time.  
  3. You agree to pay full damages to 94MB.com and all other parties concerned for any resultant loss incurred due to your use of our services.
  4. 94MB.com will ALWAYS report ALL illegal activities to any and all regulatory, administrative, and governmental authorities for prosecution. If illegal content/activities are found, your entire site including all IP addresses and log files will be downloaded. We send this entire download including the 94MB.com activity report and sent it to UK and USA law enforcement, your site will also be removed from our server. If you have any question regarding this abuse policy please feel free to contact us.
  5. If your account is found to be sending SPAM/BULK emails any illegal and/or ANY indecent content is found you agree to pay a minimum $1,000 fine PER SITE to 94MB.com to cover possible immediate damage to our reputation. If this is not paid within 48 hours this will be reported to ABC - Amega Inc, our debt collection agency who will charge you an additional $25 plus 25%. 

    Important addition to 94MB.com Spam Policy:

    In order to keep our service the most competitive and reliable for all users , we have recently updated our response to potential bulk/spam email. This will affect both free and premium users, see below:

    Free Users: If you submit bulk or spam email to our mail queue, our system will instantly remove the email from the queue and delete your account and all files and websites associated with it, this will be done automatically and once an account is terminated, the account along with all file, databases etc will be irretrievable. You MUST contact us prior to sending the offending email, after our system automatically deletes the account, there is NOTHING we are able to do to retrieve it.

    If you are sending grade A (high grade) spam (fake bank, lottery phishing, etc) , your account will be immediately deleted, we will copy your user access details to prove exactly what you were doing and IP address, location etc so we can identify you, we will then forward these details to ALL UK, USA and EU banks and also UK, USA and EU authorities. If you are taken to court, you can be liable for an unlimited fine.

    Premium Users: If you submit bulk or spam email to our mail queue, our system will hold the email in the queue until it has been reviewed by a member of staff. If we find that the email was spam, we may suspend or delete your account without refund. You will incur a reactivation fee if your site is suspended, this varies with the seriousness of the spam, if you have not paid the reactivation fee within 14 days we will delete your account along with all files.

    If you are sending grade C (low grade) spam, your account will be suspended and after contacting us, we may unsuspended your account for a £19.99 fee. 

    If you are sending grade B (mid grade) spam (porn, drugs etc), your account will be suspended, we will unsuspend your account for a £1,000 fee.

    If you are sending grade A (high grade) spam (fake bank, lottery phishing, etc), your account will be immediately deleted, we will copy your user access details to prove exactly what you were doing and payment details so we can identify you, we will then forward these details to the ALL UK, USA and EU banks and also UK, USA and EU authorities. If you are taken to court, you can be liable for an unlimited fine.

  6. You or 94MB.com may terminate your Account at any time for any reason. To remove your 94MB.com site and account, contact us, you must contain your domain name, the username and password that your account was registered with.  
  7. The 94MB.com Domain Registration Service: It is entirely down to you to check when domain names are going to expire and to ensure that they have been renewed well BEFORE this date. If you have not renewed your domain name BEFORE the expiration date, you understand that 94MB.com may re-register the domain name ON the expiration date as property of 94MB.com. Once this has been done, the domain name is property of 94MB.com and we have total ownership of it. Once a domain is 94MB.com property, it is in 94MB.com's sole discretion how it is used, whether or not we decide to keep it, place the domain name for public sale, or offer it back to you.
  8. 94MB.com will not be liable for any of its services. We have the right to cancel our service at any time, and we will not be liable for any files that are lost and/or corrupted which may occur from a system crash or hard disk failure. To the full extent permissible under the applicable law, 94MB.com shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use 94MB.com services. We highly recommend that you make hard, offline copies of your entire website, this is your responsibility.
  9. All free sites must contain the 94MB.com free hosting banner, this banners html can be found HERE. Removal of this banner without permission could result in the permanent removal of your site and all of its files. If you are using one of the 94MB.com premium services, the banner is not needed.
  10. You understand that by canceling your subscription (with out prior notice given) CAN cause all sites currently using that subscription to be instantly irrevocably terminated. If you have a subscription to a 94MB.com service, 94MB.com will immediately suspend any services that are being paid for by the subscription if the subscription is cancelled. UNLESS you contact 94MB.com before hand and receive a confirmation email allowing use of 94MB.com services for a short period of time until you re-subscribe. For example if you are updating credit cards or are changing the Paypal account you would like to make payments from. We also charge a £9.99 admin fee for reactivation of sites.
  11. Any account that our server flags up as using an unfair share of system resources such as RAM or CPU will be immediately terminated or indefinitely suspended. If you want to host a proxy, you MUST contact us first, we may then offer to setup hosting for you on our high resource server, or dismiss your request, if you are found to be hosting a proxy without prior consent, your site when found will be immediately terminated. 
  12. Any FREE account that transfers less than 5MB (0.005GB) bandwidth within 30 days will be terminated.
